Vondst advises and litigates on the full range of trademark protection issues. In the development of brands we can advise on the availability and suitability of a proposed mark. As Vondst is primarily a contentious firm, we use Dutch and foreign trademark agents to assist in the filing of applications for trademark protection for our clients. Furthermore, we draft and negotiate all types of agreements concerning the exploitation of trademarks, such as licensing, distribution, agency – and franchise agreements, co-branding agreements and other cooperation agreements.
Last but not least, we represent our clients in every conceivable type of litigation with regard to trademarks, including their granting, validity and opposition, ownership claims and, obviously, trademark infringement proceedings. Our litigation support is not limited to the Dutch courts; we support our clients before the Benelux Court of Justice, the EUIPO, the General Court and the Court of Justice of the European Union as well. Our clients can also count on us in anti-counterfeiting /custom actions and proceedings and to help coordinate proceedings before other foreign courts, where we collaborate with foreign attorneys. We also advise on IP aspects in domestic and cross border mergers and acquisitions.
