Herwin Roerdink was interviewed by national Dutch radio (BNR News radio) about the ruling of the German Federal Supreme Court brought by Unilever against the blue colour trademark of the German beauty company Beiersdorf for its well-known Nivea skin-care product. Unilever applied for cancellation of this colour trademark for lack of distinctiveness. Where the lower German court ruled that a recognition value of the blue colour in relation to the product of 75% or more was needed, the Supreme Court disagreed and ruled that 50% can be sufficient. Beiersdorf now gets the chance to present a new survey in order to uphold their colour mark.
